Inmate Sentenced to Life after Brutal Attack

PALESTINE — After 30 minutes of deliberations, an Anderson County jury handed down a life sentence to a Coffield Unit inmate Thursday for his involvement in the October 2009 assault of a corrections officer. According to the Palestine Herald, Benny Palomo, 31, was the second of three inmates to be convicted in the case.

On Oct. 19, 2009, inmate Raymond Sotelo, 26, had refused the order of corrections officer Eric Christiansen and the officer told him to returned to his cell. The inmate said “make me,” prompting Christiansen to cuff Sotelo. As he was doing so, Sotelo turned around and punched Christiansen in the face. Palomo immediately jumped in and the two took the officer to the ground. A third defendant also joined in, kicking the officer in the face and head repeatedly. During the incident, Christiansen received a black eye, bloody nose, abrasions to the side of the head and forehead and a slight concussion. The three fled and an extraction team came and took the inmates.

Sotelo was tried March 26 and 27 and was sentenced to the maximum 20 years. The trial for the third inmate involved in the case has been scheduled for June.

Navarro College Report on Post-basketball Game Incident

KILGORE — A Navarro College report issued Friday about a February disturbance after a Kilgore College basketball game says KC police were unjustified in pepper-spraying Navarro players. According to the Longview News-Journal, Navarro’s 29-page report sent to media outlets conflicts with an earlier report by Kilgore College Police Chief Martin Pessink, who concluded his two officers had used force necessary to address an escalating threat of violence. Pessink, and a private investigator who reviewed the Kilgore chief’s work, also concluded Kilgore College police should have controlled the crowd better. That report concluded the incident largely arose from the actions of a woman whom Pessink identified as a Navarro employee stirring up coaches and fans.

The Navarro report, however, said the after-game disturbance was the result of obscene, profane heckling by men whom Navarro staff thought were members of the Kilgore College football team, which lost a controversial playoff game to Navarro College a few months before.

During the Feb. 23 basketball match-up between the two schools, Kilgore defeated Navarro 88-78, leading to a celebration at mid-court. According to Kilgore College, the center-court celebration upset some players from Navarro, who “began verbalizing their disapproval which began to inflame the crowd.” Both teams by then were in their respective locker rooms. In its report, Kilgore College said Navarro College players were pepper sprayed after making threats against Kilgore College police officers who were restraining them.

In contrast, the Navarro report blamed the incident on misconceptions by Kilgore personnel. The witnesses indicated a crowd of 12 to 20 men, believed to be Kilgore College football players, heckled the team with obscene and profane comments which “went unabated throughout the game.” That heckling prompted Navarro coach Deborah Bonner to demand that it stop. Navarro witnesses said there was “apparent poor crowd control” and that several of the males involved in the heckling approached the Navarro bench — prompting a volunteer videographer to blow his whistle, as he feared a fight might break out.

Kilgore College spokesman Chris Craddock issued a statement in response to the Navarro report, noting there are two sides to any story involving a violent situation.

Store owner Laura Borens says the man then walked behind her employees, and out the door. She says she wants to find the dog soon, not because of the money, but due to the fact that when a dog is that young, it’s dangerous to suddenly change the animal’s environment. She says Spencer is on a specific diet, and if he is not fed the right kind of puppy food, it could make him sick, along with not getting his proper shots. Longview Police Arrest Man Allegedly Found Sniffing Paint in Parking Lot

williamwalkerlnjLONGVIEW — A Longview police officer responded to an unusual scene Wednesday morning when he was dispatched to the 3200 Block of Fourth Street regarding a man lying in a parking lot inhaling paint from a Sprite bottle, according to police reports. Dispatch advised that the reporting party had almost run over William Walker, 25, of Longview, according to police reports. KETK and the Longview news Journal say according to the report, when the officer arrived, he observed Walker sitting on the ground wearing a green flight suit and spraying gold paint into a Sprite bottle. The officer transported Walker to Longview Regional Medical Center for medical clearance, at which time Walker told the officer, “I’m so high, I could start a paint farm” and “I’m over the limit.” When Walker was asked to define what he meant by limit, he said, “Over the paint limit,” according to police reports. Signs posted at all four Westwood ISD campuses in Palestine read, “Notice: staff may be armed to protect students.” Superintendent Ed Lyman says the signs went up after the Sandy Hook Shooting. He says no one’s complained, but some parents are concerned. According to Lyman, “We pray that there’ll never be an accident, just like we pray there’ll never be an assault on our schools. But if there is, we want to be ready to defend ourselves.” He says the staffers who have had special training are armed, and some are former military or police officers. He tells news media the plan is adapted from one used by the Harrold ISD near the Oklahoma border.

Lake Tyler Dam Leaking

thumb_cityoftylerTYLER — Tyler Water Utilities plans to take a remediation action plan for the Lake Tyler Dam to City Council on April 24, and officials hope the remediation effort can be under construction in late summer 2013. According to city press materials, the Lake Tyler Dam was constructed in 1948-1949, using the best engineering practices at the time. Due to the foundation material used in the original construction, it is believed that there has always been seepage along the downstream toe of the embankment. This seepage is actually documented as far back as 1978, and has had no observable effect on lake elevations.

“The Lake Tyler system has an extremely small drainage basin,” said Greg Morgan, Managing Director of Utilities and Public Works. “As a result it requires substantial rainfall, almost directly on the lake to affect the lake level. This is compounded by the number of ponds and private lakes upstream of the Lake Tyler system, which are also low and intercepting runoff before it has a chance to reach the Lake Tyler system. This is the primary reason Lake Tyler remains low, despite recent rains.”

During the 2010 Dam Inspection, Tyler Water Utilities (TWU) discovered a boil (water transporting soil) in addition to the seepage. A weir was set up to measure the flow from the boil. TWU has been working with the Texas Commission on Environmental Quality and consulting engineers to develop plans for remediating this maintenance issue. “The leakage flow rate measured at the weir is approximately 30 gallons/minute,” said Morgan. “At that flow rate it would take approximately 91 years to lower the lake elevation one foot.”
