Hurricane Preparation Program


TYLER — The Texas Department of State Health Services will host a community event in Tyler as part of a 15-city “Ready or Not?” outreach tour to encourage Texans to get prepared for hurricanes. The event will feature a large tent filled with informational displays, a sample disaster supply kit, and interactive kiosks where visitors can begin or continue their emergency planning. Waterproof document bags, emergency supply checklists, and other items will be distributed. It’s all going on now and continues till 2:00 this afternoon at Broadway Square Mall. Other partners in attendance may include local fire, police, emergency management, and public health departments, as well as community organizations involved in disaster preparedness.

According to officials, hurricanes threaten Texas at this time of year, and some people may have put off planning. While it’s best to get prepared early, it’s not too late. “Ready or Not?” – or “¿Estás Listo?” in Spanish – uses radio, television, newspaper, and online advertising; community outreach events; and its website to encourage every Texan to create an emergency plan now. The goal is to help Texans be ready to respond to and recover from hurricanes as well as other natural and man-made disasters.

TxDOT Project Updates


TYLER — Here’s a quick look at events and work planned in the Tyler District of the Texas Department of Transportation.

Tyler — The Texas Department of Transportation’s annual preventative maintenance program known as “District-Wide Seal Coat” is scheduled to possibly conclude this week with crews working extensively in Smith and Wood counties. Crews will move to Farm Road 14 inside Tyler’s Loop 323 on Monday, and finish the contract with several days’ work on Farm Road 515 in Wood County between State Highway 154 south of Yantis near Lake Fork, and State Highway 37 in Winnsboro.

Daytime lane closures will be in effect in each location while the work is in progress, and flaggers will control traffic in two lane areas. Loose gravel may be present for several days following a seal coat application. Motorists are encouraged to seek alternate routes if possible to avoid delays. The District-Wide Seal Coat program, which will seal approximately 300 miles of roads as it passes through all eight counties in the Tyler District before the end of August, uses a two-step process of spraying down hot asphalt and covering it with rock to add years of life to existing pavement.

SMITH COUNTY — Texas Department of Transportation maintenance crews this week are scheduled to conclude resurfacing work on Farm Road 344 east of Bullard between Farm Road 756 and State Highway 110 south of Whitehouse, followed by the same work on Farm Road 850 east of Tyler between Farm Road 2607 and Farm Rad 3053 in Overton. Daytime lane closures will be in effect in each location while the work is in progress, and flaggers will control traffic. Motorists are encouraged to seek alternate routes if possible to avoid delays.

GREGG COUNTY — Texas Department of Transportation maintenance crews this week are scheduled to continue several weeks of base and pavement repairs on State Highway 149 between State Highway 322 in Lakeport and Farm Road 2906 (Easton Road). Daytime lane closures will be in effect while the work is in progress, and flaggers will control traffic in two-lane areas. Some overnight lane closures are possible with this work.

RUSK COUNTY — Texas Department of Transportation maintenance crews this week are scheduled to continue pavement repair operations on State Highway 64 between the Henderson Star and State Highway 42. Daytime lane closures will be in effect while the work is in progress, and motorists are encouraged to be prepared to reduce speed and merge in and around the work zone.

ATHENS — Texas Department of Transportation maintenance crews on Monday are scheduled to resurface various locations on State Highway 31 east of Farm Road 317, then move the operation to Farm Road 1616 between Loop 7 and Farm Road 773 near Murchison. Daytime lane closures will be in effect in each location while the work is in progress, and flaggers will control traffic in two-lane areas.

CHEROKEE COUNTY — Texas Department of Transportation maintenance crews this week are scheduled to continue several days of resurfacing operations on U.S. Highway 175 between Jacksonville and Farm Road 855 in Cuney. Daytime lane closures will be in effect while the work is in progress, and flaggers will control traffic in two-lane areas.

WOOD COUNTY — Texas Department of Transportation maintenance crews this week are scheduled to continue several weeks of base-repair work on U.S. Highway 80 between Farm Road 778 and the Upshur County Line. A second crew is scheduled to perform edge and ditch maintenance on Farm Road 1804 (Hoard Road) just south of U.S. Highway 80. Daytime lane closures will be in effect in each location while the work is in progress, and motorists should be prepared to reduce speed and merge in and around the work zone.

VAN ZANDT COUNTY — Texas Department of Transportation maintenance crews this week are scheduled to perform base and pavement repairs on Farm Road 1255 northeast of Canton between Interstate Highway 20 and Farm Road 773, followed by the same work on Farm Road 773 between Farm Road 16 and State Highway 64. Daytime lane closures will be in effect in each location while the work is in progress, and flaggers will control traffic.

ANDERSON COUNTY — Texas Department of Transportation maintenance crews this week are scheduled to perform resurfacing operations in various locations on U.S. Highway 287 between Farm Road 645 and Bethel. Daytime lane closures will be in effect while the work is in progress, and flaggers and pilot vehicles will control traffic.

Teen Facing a Variety of Charges after Shooting Incident


TYLER — A teenager remains in custody today following a weekend incident at the Smith County Juvenile Attention Center. Shortly after 12:15 Saturday morning officers responded to a call at the center of shots being fired. The officers found a 16 year old from Kansas City, Missouri in a secured hallway within the facility. The youth had a gun to his head attempting to get officers to shoot him. They were able to convince him to put the gun down.

The youth had been arrested Friday night at the Tyler bus station. Around 9:00pm, Tyler Police received information that the juvenile was on a bus from Kansas City, Missouri to Tyler and he had outstanding warrants. He is wanted for assault, failure to appear, and being a runaway. Officers contacted the teen on the bus and took him into custody.

He was transported him to the Tyler Police Department and then to the Smith County Juvenile Attention Center. While the he was being held in a secured intake room in the facility, he gained access to his personal duffel bag that contained a handgun hidden in his clothing. He took the handgun from the bag and fired several shots within the intake holding room. The intake officer took cover and was not injured. Tyler police spokesman Don Martin says no juveniles housed in the facility were in any danger during the incident. The teen had been searched at the time of the arrest; however his bag was not searched prior to being placed into the trunk of the patrol vehicle.

The juvenile was transported to East Texas Medical Center for minor injuries he sustained by cut glass during the incident. He was treated and released back into the custody of officers. The youth was charged with aggravated assault on a public servant, possessing a deadly weapon in a penal institution, possession of controlled substance marijuana and directive to apprehend from Missouri.

Mijalis Dies in Longview


LONGVIEW — Funeral services will be held in Longview tomorrow for longtime businessman and restaurateur Spiro S. Mijalis. Mijalis died Saturday from a heart attack. He was 72. Mijalis started Fisherman’s Market in 1973 and the Butcher Shop in the early 1980s. Funeral services for Mijalis will be Tuesday afternoon at 2:00 in the chapel at Rader Funeral Home in Longview. Burial will follow in Rosewood Park.

New Rangerettes Named


KILGORE – Three dozen young women are the newest members of the world-famous Kilgore College Rangerettes dance and drill team. The announcement, made in a closed ceremony in Dodson Auditorium on the Kilgore campus, culminates a week-long tryout process that saw 107 hopefuls vying for a coveted position on the 71st Rangerette line. The new Rangerettes will join 35 sophomores to make a line of 71.

The Rangerettes were the first of their kind when they began in 1940 as a vision of the late Gussie Nell Davis. The organization created a unique combination of dance moves and precision drills that quickly earned them the reputation not only as the originators of dance/drill teams, but as the best in the world. Known for their high kicks and the jump splits, the organization has traveled around the world and entertained millions.

Palestine Robbery Suspects Arrested


PALESTINE — Both of the suspects in the Thursday night robbery of the Palestine Wal-Mart Supercenter are now in custody. The suspects have been identified as Terrance Lavar Williams, 31, and Michael-Anthony J. Darkins, 21. Both are from Palestine. They have been charged with aggravated robbery. The robbery happened around 10:30 Thursday night. Reports indicate a shot was fired inside the store, but not injured.

Harrison County Jail Suicide

Prison BarsMARSHALL — An inmate of the Harrison County Jail has died after hanging himself in his jail cell. Jecori Montra White, 34, of Marshall, was arrested Wednesday morning and charged with aggravated assault-family violence. He was believed to be under the influence of narcotics at the time of his arrest. According to a news release from the sheriff’s department, White was found hanging in his cell around 5:20 Thursday afternoon. He was rushed to Good Shepherd Medical Center-Marshall, where he was pronounced dead about an hour later.

Bank Heist Suspect Arrested

Tyler Robbery PhotoTYLER – Tyler police have confirmed the suspect in the July 14 robbery of the BBVA Compass Bank has been arrested. According to KETK, Tyler FBI officials say 61-year-old Eddie Ray Myers was arrested without incident. Shortly after his arrest he was taken to East Texas Medical center after complaining of chest pains. Precinct 5 constables were doing surveillance when they saw Myers enter a house. Deputies pulled him over and arrested him. Myers was on parole in Arkansas, but was living in Tyler. It is unknown when Myers will be moved to a jail.

Sonic Temporarily Closed


TYLER — The Sonic Drive-In on South Broadway in Tyler is temporarily closed. According to KETK, a spokesman for the chain says local health and police departments are investigating an allegation the restaurant may be involved in a food-borne illness or food tampering incident. No other information was immediately available.

Red Cross, Wells Fargo Team Up


EAST TEXAS — The American Red Cross in East Texas is partnering with Wells Fargo Advisors on Operation American Pride. According to a Red Cross news release, “In celebrating the greatness that is America, and our freedom, we can do no less than thank the young men and women, around the world, that serve as the guardians of our freedom.” The Red Cross and Wells Fargo have committed to filling boxes, during the month of July, with items needed by military personnel. The Red Cross has collected money and shopped for the items. Wells Fargo Advisors has collected approved items and will be paying all shipping costs involved to get the provisions to troops in Iraq and Afghanistan.

Friday morning, the Smith County Red Cross delivered its items to the Wells Fargo Advisors offices in Tyler. In Longview, the East Texas Piney Woods Chapter delivered its items to the local Wells Fargo offices on Thursday.

Bikers’ School Supply Drive


TYLER — Hundreds of motorcycle enthusiasts gathered Saturday in the north parking lot of Broadway Square Mall before their 100-mile ride throughout East Texas collecting school supplies for the annual PATH School Supply Train. The 2nd annual “Bikers Rule 4 School” will get underway around with Mayor Barbara Bass will kick things off.

The caravan left Broadway Square Mall at on a route that took them to several stops throughout East Texas. Those include Brookshire’s/Bullard,, Brookshire’s/Whitehouse, Brookshire’s/Troup, Arp City Park, Chapel Hill Bethel Baptist Church, New Zion Baptist Church/Winona, Lowe’s/Lindale and back to Broadway Square Mall/Tyler.

PATH distributes school supplies to elementary, middle and high schools in Smith County prior to the beginning of the ’10-’11 school year. PATH staffers say parents who need help with school supplies for their children should contact their school before the beginning of the fall semester. DA Won’t Block Mental Evaluation

TYLER — The Smith County District Attorney’s office will not block a complete mental evaluation of the teenager accused of fatally stabbing his John Tyler teacher last September. That’s according to a brief filed by his attorney. The student was 16 at the time of the incident. According to KETK, Texas law requires such an examination be made before trying someone as young as Byron Truvia as an adult.

Palestine Armed Robbery


PALESTINE — One person is in custody and one being sought in the robbery of the Palestine Wal-Mart Supercenter. The robbery happened around 10:30 Thursday night. Reports indicate shots were fired inside the store and that one store employee was pushed to the ground, but not injured. According to KETK-TV, one suspect was arrested near an apartment complex shortly after the robbery. They are still looking for the second suspect.

Budget Cuts at TJC


TYLER – Cuts made by the state to funding for community colleges and no increase in property tax revenues are the main reasons Tyler Junior College is facing a projected $1.5 million budget shortfall. KETK-TV reports the school’s taken action to address the problem.

School officials have instituted a near-hiring freeze, construction projects are being delayed, technology upgrades are delayed, and august graduation ceremonies have been done away with. So far, not too many cuts have affected students, but school officials say if money troubles continue, students could be more directly impacted.

Guilty Plea in Health Care Fraud Scheme


TYLER – A 49-year-old Henderson woman has pleaded guilty in Tyler to federal health care fraud-related charges. Sheena Shelton pleaded guilty to health care fraud and wire fraud Thursday before U.S. Magistrate Judge John D. Love.

According to officials, from 2003 to 2009, Shelton controlled and operated KC Medical Supplies, a durable medical equipment supplier in Longview. During that time, Shelton devised and carried out a scheme to defraud Medicare and Medicaid by submitting fraudulent claims for equipment and supplies which had not been prescribed or authorized by a physician. Shelton prepared documents that falsely represented that physicians had prescribed or ordered medical equipment for certain beneficiaries although they had not. Shelton forged the signatures of local physicians to fraudulent claim forms before submitting them to Medicare and Medicaid for payment.

Shelton faces up to 10 years in federal prison for the health care fraud charge and up to 20 years in federal prison for the wire fraud charge. A sentencing date has not been set.

Guilty Plea in Drug Case


TYLER – A 26-year-old Carthage man has pleaded guilty to federal drug violations. During an appearance Thursday in Tyler before U.S. Magistrate Judge John D. Love, Jeremy Kristopher Ivie pleaded guilty to possession of pseudoephedrine with the intent to manufacture methamphetamine. According to information presented in court, on Jan. 31, 2009, Ivie purchased cold pills containing pseudoephedrine at a Wal-Mart in Longview in addition to making three other purchases that same day at other stores in the area, all in furtherance of his methamphetamine manufacturing activities. A federal grand jury returned a 256-count indictment on Feb. 2, 2010, charging Ivie with federal drug violations. Ivie faces up to 20 years in federal prison at sentencing. A sentencing date has not been set.

Restaurant Catches Fire

Fire  HoseTYLER — A bit of a scare, but it could have been much worse as a Tyler restaurant catches fire. According to KETK, the Tyler Fire Department responded to the two-alarm blaze just before 7:15 Wednesday night at Bourbon West, 1523 East Erwin. The fire began in a bucket near an outside grill that was used to store ashes from the grill. Flames then traveled up an outside wall and entered the attic space. There was approximately $1,500 in damages and no injuries were reported.

New Parking Garage for ETMC

ETMC ConstructionTYLER — A new $20 million, six-level parking garage with over 950 spaces opened recently on the east side of the ETMC Tyler campus. The skywalk now extends over Hospital Drive to connect to the new east parking garage. “We are now directing visitors to park there,” said Bob Hampton, vice president of property services for ETMC. “The spaces are extra wide so all types of vehicles will easily be able to get in and out of their slot. Visitors will also be able to enter the hospital on the new extension of the skywalk.” The front parking lot where the helicopters are located will now be used for handicap parking, valet and clergy as space allows.

“Another change will be no parking anymore on Hospital Drive, the street that goes around ETMC,” said Hampton. “The street will be converted to a boulevard and will have designated turn lanes. Without cars parking on Hospital Drive, it will be a lot safer for drivers and pedestrians.” Plans for the front of ETMC involve creating a new entry way from Hospital Drive. Over the next several months, sections of the Olympic parking garage will close so the spaces can be redesigned to make them bigger and easier to maneuver like the new east garage. Next to the new parking garage is a new central plant for heating, cooling and supporting the hospital.

Other construction updates for ETMC Tyler:

– ETMC Tyler is also working to beautify the campus with more green spaces. Hospital officials say beautiful plants and trees, native to Texas, were planted around the new east parking garage.

– Behind the hospital, the area used by the construction crews will be converted back into spaces for the Pavilion conference center. A small building was razed, and that area will become green space.

– The physician office on Beckham street across from the hospital moved in mid-July to a new clinic space at Fifth Street and Beckham. The old building will be leveled, and a green space will be created.

Nation’s Oldest Person Celebrates Another Year

Eunice SanbornJACKSONVILLE (AP) – The nation’s oldest person, an East Texas resident, has celebrated yet another year. But which year is a matter of mild debate. The Gerontology Research Group in Los Angeles lists Eunice Sanborn at 114, validating her as the oldest person in the U.S. and the second oldest in the world. A lady in France has her beat by about five months for top international supercentenarian. However Sanborn, a longtime Jacksonville resident, and her friends say she was actually born on July 20 in 1895, not 1896 as the official record states. That makes her 115. The Tyler Morning Telegraph reports that Sanborn has been resting up since partying with 100 well-wishers at her birthday bash at the First Baptist Church in Jacksonville on Tuesday.

Fire Station 6 Grand Opening

Longview Fire DeptLONGVIEW — The City of Longview Thursday hosted a Grand Opening Ceremony for the newly constructed Fire Station 6, located at 2808 McCann Rd. As part of the Capital Improvements Projects bond election in May 2007, voters approved $2.5 million in bond funds for fire station improvements. Fire Station 6 is a 10,701 square foot building that features sleeping quarters for twelve, four apparatus bays, kitchen, living area, and work spaces. The cost of land and construction was approximately $1.83 million.

According to interim Fire Chief J.P. Steelman, “Fire Station 6 is one of our busiest stations in terms of calls per shift. The size and functionality of the new station will be a great resource for the men and women that serve in the Longview Fire Department.” Prior to construction of the new building, Fire Station 6 was located at 1515 Judson Rd. In addition to the construction of Fire Station 6, bond funds have been used to expand and renovate Fire Station 2, located at 708 N. Eastman Road.

White Visits East Texas

TYLER — Democratic gubernatorial candidate BIll White spends a couple of days touring East Texas. Though the area’s a Republican stronghold, White tells KTBB he’s confident of his chances here. He says, “I’m a traditional Texas Democrat, a fiscal conservative.” White also mentioned the success he enjoyed as mayor of Houston. He pointed out that in two re-election contests, he won over 80 per cent of the most conservative Republican precincts in that city. White added that a lot of fiscal conservatives like the idea of having someone in public office who’s met a payroll and been a successful business person.

East Texas Baseball Coach Arrested

FingerprintsMABANK — A Mabank baseball coach has been arrested and charged with indecency with a child. Arrested Wednesday was Kevin Reed, 34, of Gun Barrel City. He turned himself in to authorities after an arrest warrant was issued. The warrant was issued after a woman alleged that Reed inappropriately touched her ten year old son. Reed is currently free on a $10,000 bond.

Murder Suspect Surrenders

Crime TapeLONGVIEW — The suspect charged with murder in the death of Brian Keith Burnett on Tuesday surrendered at the Gregg County Sheriff’s office Thursday afternoon. KETK reports his surrender was arranged through Longview Attorney Lance Larison. “James Nathan Alexander charged by a criminal complaint Wednesday with this offense, some 22 hours after investigators, Texas Rangers and ATF agents, worked had around the clock on the case examining evidence and conducting interviews,” Captain Mike Claxton said. After his surrender Alexander was taken to an arraignment hearing in Judge B.H. Jameson’s courtroom. His bond was set at $100,000. Alexander, of Harrison County, remains in custody. Burnett’s body was found around 7:30 Tuesday night at Riverside RV Park.

Meanwhile, the investigation continues in an apparently unrelated case after the body of a woman was found around 4:00 Tuesday afternoon wrapped in a blanket near the Sabine River. She has been identified as a missing Longview woman, Sygunda Yvette Williams, 34. She wasn’t reported missing to police and it was only discovered when investigators pursued leads as to the identity of the body. Fingerprints obtained during an autopsy at the Tarrant County Medical Examiner’s Office were used to confirm Williams’ identity late Wednesday afternoon and her family was officially notified by investigators. Longview Police Detectives have reason to believe her death may have been caused in Longview and are awaiting the official cause of death to be announced. Detectives are currently interviewing family members, friends and associates of Williams and are submitting items for forensic testing. Authorities have not named any suspects in Williams’ death.

Mower Death an Accident

EMSTYLER — The weekend death of a Smith County woman appears to be accidental. Anjanette Herring, 40, was found dead under a lawn mower Sunday afternoon. The accident occurred off County Road 26. According to KETK-TV, the woman’s husband told deputies his wife had been mowing an overgrown trail down to the creek. He says he had turned around to do something else when the incident occurred. Investigators say the case is still an open investigation, but all indicators point to it being an accident.

Gohmert Helps Kick Off Tea Party Caucus


WASHINGTON (AP/Staff) — Tyler Congressman Louie Gohmert was among the speakers as the new Tea Party Caucus got off the ground Wednesday in Washington. Gohmert says the purpose is “to try to get both parties back on track, back to the things that made America great.” Republican Rep. Michele Bachmann of Minnesota says she founded the Tea Party Caucus so it could be a “receptacle” for the views of average citizens, not to push an agenda. She says Congress is not listening to the Tea Party movement and her caucus is designed to clear the way so that members can be heard.

Gohmert mentioned some harsh remarks directed at him during the health care debate. He said he didn’t complain to the media because “we move on, we got elected to do a job.” Bachmann says the just-formed caucus has 24 members, including the third-ranking GOP member of the House, Rep. Mike Pence of Indiana. She says she also hopes Democrats will join the caucus. House Republican Leader John Boehner of Ohio has declined to join the caucus.

Counterfeiting Sentence

CounterfeitingTYLER – A 45-year-old San Antonio man has been sentenced in Tyler to federal prison for counterfeiting violations. Mark Merryman pleaded guilty on March 8, to counterfeiting and was sentenced to 12 months in federal prison Wednesday by U.S. District Judge Leonard Davis. Judge Davis also ordered Merryman to pay restitution in the amount of $440 to area merchants and to forfeit ownership in office equipment used in the scheme. According to information presented in court, on December 23, 2008, Merryman used a printer/scanner/copier to counterfeit and alter approximately 16 counterfeit $20 bills in Palestine.

Another Successful Cattle Barons’ Gala


TYLER — Another big year for the Tyler Cattle Barons’ Gala is announced at a wrap-up party. The final take: over $531,000 for the American Cancer Society. Spokesperson Kristi Boyett says attendees loved headliner Lee Ann Womack, the silent auction, and all the fun and games. Family Serves Jail Time for Fraud

MortgageCORSICANA — The fourth member of a multi-county mortgage fraud scheme has pleaded guilty to a first-degree felony for his role in a multimillion dollar enterprise that defrauded government-backed mortgages. Darrell Lynn Marriott, 57, of Gun Barrel City in Henderson County, was sentenced in Navarro County District Court to 28 years in prison for securing the execution of a document by deception. Under the terms of the plea deal, the defendant will now enter an identical plea in Kaufman County.

In a separate but related matter last month in Wilbarger County, Marriott pleaded guilty to the same charge involving a single home purchase. The district court sentenced him to nine years in prison.

The defendant’s wife, Kandace Y. Marriott, 54, is currently serving a 99-year sentence after a Navarro County jury in March 2009 found her guilty of first-degree mortgage fraud. In July 2009, she was also sentenced to two 20-year terms after pleading guilty in Kaufman County. Her sister, Karen Hayes, 59, of Henderson County, is currently serving an 18-year sentence for falsifying documents to obtain property or credit. The Marriotts’ daughter, Kally Marriott, 24, of Rockwall, was also charged with engaging in organized criminal activity for securing the execution of a document by deception. She pleaded guilty to a third-degree felony last December and served four months in jail as a condition of her probation.

Where is Charley Jones!!? Have you dropped his show? We miss him!

I share your disappointment that Charley Jones is no longer on the air at KTBB. We like the show and I like Charley. I have known him for over 35 years.

The reason we stopped carrying the show is not because of the show itself. It is because of the Texas State Network. TSN is the network that syndicates Texas Overnight and the network, due to severe cuts in personnel, has devolved into a sloppy, inattentive mess.

When the Texas State Network has technical difficulties in the middle of the night, there is no engineer on hand to clear the problem. What this has meant for us in practical terms is that when the network feed goes down, as it does with distressing frequency, there is literally NO ONE AT THE NETWORK that we can call. We are then left to scramble to get something on the air.

Texas State Network no longer takes live technical trouble calls from affiliates. If an affiliate has a technical problem (or more accurately if the network has a technical problem that results in cessation of delivery of
programming to affiliates), affiliates are supposed to email the trouble report to TSN. Our experience with TSN on this is that the emails are either never acknowledged or are acknowledged hours or in some cases days after the fact.

When TSN goes down in the middle of the night, it causes serious disruptions to our operation. The frequency of TSN’s difficulties, coupled with their indifferent response, has thus led us stop taking their syndicated programming. Replaying Rush’s broadcast from the previous afternoon is something over which we have total control. We have zero control when it comes to fixing problems at TSN and apparently very little influence over them. Our oft expressed concerns regarding their frequent problems fell on deaf ears. That’s why we made the decision that we made.

I appreciate the fact that you miss Charley Jones. As I say, I have known Charley for over three and a half decades and respect him a lot. But his network is letting him down and we simply cannot allow their sloppy
operation to negatively affect us any longer.
