Jeremy Kernodle, a Trump-appointed federal judge in Tyler, stated that \u00e2\u20ac\u0153the Court lacks subject matter jurisdiction over this case and must dismiss the action.\u00e2\u20ac\u009d On Jan. 6, the vice president will preside over the joint session to certify the election results.<!--more--> The lawsuit, which was filed by Gohmert and 11 Arizona electors, originally sought to give Pence the ability to \u00e2\u20ac\u0153determine which electors\u00e2\u20ac\u2122 votes, or whether none, shall be counted\u00e2\u20ac\u009d when there is any objection to the slate of electors.<\/p>\n<p>In his dismissal of the lawsuit, Kernodle stated that Pence\u00e2\u20ac\u2122s anticipated actions on Jan. 6 will not impact the decision of Arizona Gov. Doug Ducey regarding the certification of electors, as that occurred more than two weeks ago on Dec. 14. In Arizona, the Democratic Party\u00e2\u20ac\u2122s slate of 11 electors voted for Joe Biden and Kamala Harris. The votes were certified by Gov. Ducey and Arizona Secretary of State Katie Hobbs and submitted.<\/p>\n<p>\u00e2\u20ac\u0153Even \u00e2\u20ac\u02dcratifying\u00e2\u20ac\u2122 or \u00e2\u20ac\u02dcmaking lawful\u00e2\u20ac\u2122 the Governor\u00e2\u20ac\u2122s decision, as Plaintiffs argue will occur here, will not have any \u00e2\u20ac\u02dccoercive effect\u00e2\u20ac\u2122 on Arizona\u00e2\u20ac\u2122s certification of electoral votes,\u00e2\u20ac\u009d Kernodle wrote.
