GILMER \u2013 The Upshur County grand jury has upgraded the charge against a teen involved in a fatal accident. Originally, Benjamin Lee Powers, 19, of Gilmer, was charged with criminally negligent homicide. This week, the grand jury indicted him for manslaughter. <\/p>\n
Authorities say on December 30th, Powers was driving his pickup on Farm Road 49 when he tried to pass a vehicle in a no passing zone. The Department of Public Safety says Powers lost control of the truck and crashed. A passenger, Caderrius Green, 19, of Gilmer, was killed.
