{"id":1519191,"date":"2026-06-30T07:26:33","date_gmt":"2026-06-30T12:26:33","guid":{"rendered":"https:\/\/ktbb.com\/post\/?p=1519191"},"modified":"2026-06-30T09:40:27","modified_gmt":"2026-06-30T14:40:27","slug":"supreme-court-is-set-to-rule-on-trumps-challenge-to-birthright-citizenship","status":"publish","type":"post","link":"https:\/\/ktbb.com\/post\/?p=1519191","title":{"rendered":"Supreme Court is set to rule on Trump\u2019s challenge to birthright citizenship"},"content":{"rendered":"<div class=\"col-6 details-info\">\n<div class=\"bottom pt-lg-3\">\n<div class=\"story-block mt-4\">\n<div id=\"P_body\" class=\"story-block\">\n<p>WASHINGTON (AP) &#8211;\u00a0<a href=\"https:\/\/apnews.com\/hub\/us-supreme-court\">The Supreme Court<\/a> on Tuesday will rule on the constitutionality of <a href=\"https:\/\/apnews.com\/hub\/donald-trump\">President Donald Trump\u2019s<\/a> order on <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/protecting-the-meaning-and-value-of-american-citizenship\/\">birthright citizenship<\/a> declaring that children born to parents who are in the United States illegally or temporarily <a href=\"https:\/\/apnews.com\/article\/birthright-citizenship-trump-supreme-court-constitution-ed436346abc459fdea6c5cecc410bdc2\">are not American citizens<\/a>.<\/p>\n<p>The decision comes on the final day of a Supreme Court term that has centered on Trump\u2019s expansive claims of presidential power \u2014 and largely ruled in his favor.<\/p>\n<p>The court on Monday handed Trump a major win by <a href=\"https:\/\/apnews.com\/article\/supreme-court-executive-power-trump-firing-cook-7b7676e5a066f8df41077a0920b9f334\">upholding his firings of independent federal agency heads at will<\/a>, with the exception of Federal Reserve governor Lisa Cook, who will retain her job <a href=\"https:\/\/apnews.com\/article\/supreme-court-executive-power-trump-firing-cook-7b7676e5a066f8df41077a0920b9f334\">while she fights the president\u2019s effort to fire her<\/a> over allegations of mortgage fraud.<\/p>\n<p>Here&#8217;s the latest:<\/p>\n<h4 class=\"mb-0 pb-2 ap-font-bold\">How do most countries decide a child\u2019s citizenship?<\/h4>\n<p>Outside of the Americas, most countries follow the legal principle of jus sanguinis, or \u201cright of blood,\u201d with a child\u2019s citizenship inherited from its parents, no matter the place of birth.<\/p>\n<p>In the European Union, for example, no member states grant automatic, unconditional citizenship to children born to foreigners.<\/p>\n<p>But American legal practice is descended in many ways from English common law, which had long provided for citizenship based on a child\u2019s place of birth, the legal concept of jus soli, or \u201cright of soil.\u201d<\/p>\n<p>The UK, though, abandoned jus soli with the British Nationality Act of 1981.<\/p>\n<p>Under the new rules, people born in the UK get citizenship only if at least one parent is a British citizen or has \u201csettled status\u201d under the law.<\/p>\n<h4 class=\"mb-0 pb-2 ap-font-bold\">The justices will read summaries of their opinions<\/h4>\n<p>The court will dive right into the remaining decisions when the justices take the bench at 10 a.m. ET.<\/p>\n<p>The opinions are typically read in ascending order of seniority so that the most junior justice with an opinion goes first. Chief Justice John Roberts, who may well have the decision in the birthright citizenship case, would go last.<\/p>\n<h4 class=\"mb-0 pb-2 ap-font-bold\">Monday\u2019s ruling on federal agencies dramatically expanded presidential power<\/h4>\n<p>Other than at the Federal Reserve, with its role of setting interest rates, the court held that <a href=\"https:\/\/apnews.com\/article\/supreme-court-executive-power-trump-firing-cook-7b7676e5a066f8df41077a0920b9f334\">presidents have free rein to fire agency heads at will<\/a>, despite federal laws that require a cause for such dismissals and a <a href=\"https:\/\/apnews.com\/article\/humphreys-executor-supreme-court-trump-independent-agencies-8facfe6107fa94b28f391734d1620fe4\">91-year-old decision<\/a> that had limited executive authority.<\/p>\n<p>The justices allowed Fed governor Lisa Cook to stay in her job while she fights Trump\u2019s effort to fire her over allegations of mortgage fraud, which she has denied.<\/p>\n<p>With the six conservative justices in the majority, the nine-member court jettisoned its unanimous decision in Humphrey\u2019s Executor that had limited when presidents can fire agencies\u2019 board members \u2014 in part to try to ensure decision-making free of political influence.<\/p>\n<p>\u201cWe hold that such protection from removal is contrary to the separation of powers enshrined in the Constitution,\u201d Chief Justice John Roberts wrote for the court.<\/p>\n<h4 class=\"mb-0 pb-2 ap-font-bold\">The court will also rule on trans athletes and campaign finances<\/h4>\n<p>In separate cases, the court will also decide:<\/p>\n<p>Whether states can prohibit transgender athletes from playing on girls\u2019 and women\u2019s public school and college teams.<\/p>\n<p>Whether to uphold a federal law more than 50 years old limiting how much political parties can spend in coordination with candidates for Congress and the president.<\/p>\n<h4 class=\"mb-0 pb-2 ap-font-bold\">The court seemed poised to reject Trump\u2019s birthright citizenship limits during arguments in April<\/h4>\n<p><a href=\"https:\/\/apnews.com\/article\/supreme-court-trump-birthright-citizenship-immigrants-4dca3a4e06f58d4378412ed711fab3a8\">Oral arguments for the case<\/a> lasted more than two hours in a crowded courtroom that included Trump, the first sitting president to attend arguments at the nation\u2019s highest court, and, in seats reserved for the justices\u2019 guests, actor Robert De Niro.<\/p>\n<p>Trump heard his administration\u2019s top Supreme Court lawyer, Solicitor General D. John Sauer, face one skeptical question after another. Justices asked about the legal basis for the order and voiced more practical concerns.<\/p>\n<p>\u201cIs this happening in the delivery room?\u201d Justice Ketanji Brown Jackson asked, drilling down into the logistics of how the government would actually figure out who is entitled to citizenship and who is not.<\/p>\n<p>Chief Justice John Roberts suggested that Sauer was relying on quirky exceptions to citizenship to make a broad argument about people who are in the country illegally. \u201cI\u2019m not quite sure how you can get to that big group from such tiny and sort of idiosyncratic examples,\u201d Roberts said.<\/p>\n<p>Justice Clarence Thomas sounded the most likely among the nine justices to side with Trump.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"col-6 details-media\">\n<div class=\"vd-hits-header\"><\/div>\n<div id=\"div_description\" class=\"description\">\n<p>&nbsp;<\/p>\n<\/div>\n<div class=\"bottom\">\n<div class=\"meta-block px-0\">\n<div class=\"details-summary\">\n<div id=\"tr_photo_details\" class=\"row-span\"><\/div>\n<\/div>\n<\/div>\n<div class=\"info-block\">\n<div class=\"note use-block\">\n<div id=\"div_useinfo\" class=\"body\" aria-labelledby=\"useInfoTitle\"><\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>WASHINGTON (AP) &#8211;\u00a0The Supreme Court on Tuesday will rule on the constitutionality of President Donald Trump\u2019s order on birthright citizenship declaring that children born to parents who are in the United States illegally or temporarily are not American citizens.
