According to his arrest affidavit and our news partner KETK, the crash occurred Jan. 17 on a two-lane road between the 3900 block and 4000 block of College Drive and FM 819. The crash involved a white Mercedes-Benz driven by Fidone and a black Kia Forte.<\/p>\n<p>Lufkin police officers were dispatched after receiving a call stating there was a car crash and a potential fatality. Once on the scene, officers found Fidone\u2019s car on the shoulder of the southbound lane facing northbound. His car sustained extensive damage to the front left side and multiple airbags were deployed, according to the affidavit.<\/p>\n<p>After officers observed Fidone walking near his vehicle, they checked the Kia\u2019s occupants and found the passenger slumped over and the driver, D. Marcus Hadnot, slumped over the steering wheel, motionless. A dog was also found inside the Kia, deceased, and was later picked up by animal control.<!--more--><\/p>\n<p>The Lufkin Fire Department was called for additional medical assistance and once on scene, they began helping the passenger in the Kia, while also performing life-saving measures on Hadnot, who was later pronounced dead at a local hospital.<\/p>\n<p>Fidone later approached the Kia to check on the occupants and told officers, \u201cI was just on my phone,\u201d the affidavit said.<\/p>\n<p>After attending to Fidone and Hadnot, officers spoke with a witness of the crash, who believed that Fidone was on his phone at the time because he was drifting into another lane and made an erratic turn to get back into his lane, according to officials.<\/p>\n<p>The witness also stated that he observed Fidone driving at an unsafe speed and that he was partially in the other lane when he struck the Kia head-on.<\/p>\n<p>Before being taken to a local hospital for minor injuries, Fidone admitted to officers that the crash was his fault, stating that he drove into their lane, according to the affidavit.<\/p>\n<p>Fidone was later arrested after his blood collected from the crash reported a blood alcohol level of 0.14, according to the affidavit.<\/p>\n<p>Following his arrest, Fidone was charged with two counts of intoxicated manslaughter with a vehicle and two counts of intoxication assault with a vehicle. His bond was set at $92,500.
