Voters Passed Local Options in JP 1 and 4

SMITH COUNTY — The legal sale of beer and wine for off-premise consumption has been approved by voters in Justice of the Peace Precints 1 and 4. According to the Smith County Election Administrator, 109 potential votes were not counted and would have to be retrieved from the electronic voting machines at the Elections Office. The official did say they retrieved votes would not affect the outcome.

The proposition in Precinct 1 passed 68.7 percent, or 359 votes, to 32.3 percent, or 163 votes, according to unofficial results. Precinct 4 voters had rejected legalizing sales twice before legalizing sales 59.9 percent, or 768 votes, to 40.1 percent, or 514 votes, according to incomplete results.

City of Tyler voters legalized the sale of beer and wine in November 2012.

According to KETK, stores in these areas will have to apply for a license before they are able to begin selling. It typically takes from 45-60 days for the licenses to go through the proper review process. The process entails requiring the local City Secretary and County Clerk to confirm the retailer is located in a ‘wet’ area and then the license goes to the Texas Alcoholic Beverage
