Former Pharmacist Posts Bond On Sex Complaint

james_prosperie_smith_jailTYLER — A former Tyler pharmacist accused of sexually assaulting a child is free on bond today. James Carey Prosperie, 73, posted a $100,000 surety bond and was released from the Smith County Jail around 11:30 Thursday night. Prosperie was arrested following a standoff with police. He is accused of sexually assaulting a 14 year old relative at least twice. He is charged with aggravated sexual assault of a child. According to the arrest affidavit, the detective working the case feels there is good reason to believe that Prosperie assaulted the teenage on June 8th. According to a report from the CPS, Prosperie told a friend, who is a lawyer, that he had sexual contact with the underage relative on at least two separate occasions.

Prosperie’s bond comes with the following conditions:
1. Prosperie shall submit to testing on a weekly basis for the presence of a controlled substance at the Smith County Adult Probation Department. If he fails to report, does not submit to testing or fails test, he will be arrested and a new bond will be set.
2. Prosperie shall not communicate, in any manner, with the the relative of which he is accused of assaulting or go anywhere the relative is, except for visitation approved expressly by and directly supervised by an authorized official of the Texas Department of Human Resources.
3.Prosperie is ordered to immediately report to the Adult Probation Department, upon release from the Smith County Jail.
4. Prosperie is ordered to not go within 500 feet of the relative of which he is accused of assaulting, or anywhere they may be located.
5. Prosperie cannot use, possess or consume alcoholic beverages, illegal drugs or narcotics as a condition of bond.
