Dallas man arrested for assaulting officer

SMITH COUNTY – According to arrest records, a man from the Dallas area assaulted a Smith County deputy on Sunday morning while attempting to take the deputy’s gun and repeatedly resisting arrest. Members of a nearby church allegedly intervened to assist, according to the documents. Delano Davis is accused of resisting arrest, assaulting a peace officer, trying to steal a weapon from an officer, and interfering with public duties. Since Sunday, he has been detained at the Smith County Jail. Around 11:20 a.m. on Sunday, a Smith County Sheriff’s Office deputy responded to a call regarding a man stepping in front of moving cars close to County Roads 165 and 168 in the Flint-Gresham area, according to an arrest affidavit.

The man, who was identified as Davis, was approached by the deputy, who questioned him about why he was walking in front of cars. At first, Davis obeyed orders. The deputy saw that Davis was perspiring a lot and seemed to be under the influence of an unidentified substance.

The deputy discovered Davis had bond conditions outside of Collin County after reviewing records. According to the affidavit, Davis approached the patrol car’s passenger side while doing this, opened the door, and started tossing objects onto the floorboard. Davis claimed the deputy was going to give him a ride when the deputy ordered him to leave. “We are going to ride,” Davis said in response to the deputy repeating the directive. Then the deputy emerged and restrained him with a Taser.

When the deputy attempted to arrest Davis, he put his hands behind his back and withdrew, threatening to shoot him. Davis became “fixated” on his gun and attempted to grab it, according to the deputy’s report. After removing the prongs, Davis approached the deputy, who then used three more Taser cycles, knocking Davis to the ground. Davis lifted the deputy when he tried to arrest him, and another attempt to use a Taser was unsuccessful. Davis struggled in the street and attempted to seize objects by reaching around the deputy’s belt. According to the deputy, Davis reached for the Taser holster and made another attempt to seize his gun.

He called for assistance from people in a nearby church parking lot while the deputy was on his back. According to the deputy, Davis hit him in the left side of the face, shattering a lens and knocking off his glasses. Davis was struck back by the deputy. Then, as the deputy held Davis, a churchgoer assisted in getting him to the ground. The deputy claimed that while Davis was still fighting, three churchgoers got on his back. They assisted the deputy in handcuffing Davis. Until help arrived, they kept him on the ground.

Davis resisted once more while being assessed by EMS in the patrol car, and pepper spray was used, but it was ineffective.The deputy’s right elbow, left cheek, and both knees were bruised during the altercation, according to the affidavit.
