TYLER — The man accused of killing James Brandon Lee last December during a party at Deputy Terry Lindsey’s house will be able to use his mental health history as a defense. That’s according to KETK. A Smith County judge ruled Tuesday that records of Joshua Dwain Barnes’s fantasies about killing people will be allowed in court. His trial is set for October 4th.
LONGVIEW — A Longview man is arrested for retaliation. Travis Dewayne Brown, 32, of Longview remained jailed at last report on $5,000 bond, charged with third degree felony retaliation. KETK reports, Longview police arrested Brown shortly before 5:00 Sunday in the 900 block of Oden Street, after store personnel at the Mobberly Mart at 301 Mobberly Avenue said Brown had broken a window and threatened to beat up employees for filing a criminal mischief report against him in July, according to arrest reports. Brown has a long wrap sheet, including: possession of marijuana, criminal trespass, disorderly conduct and assault.
HENDERSON — A 16-year-old Henderson High School student suffers a fatal head injury. Mahlon Acres reportedly fell off the back of a truck Friday night and hit his head. Police say several students were in the cab and bed of a truck when the truck swerved around a corner and Acres fell out. He was taken to a hospital where he was kept on life-support on Sunday. According to KETK, police say no alcohol was involved in the accident.
MARSHALL — An arrest has been made in the murder of Shirlette Green, 44, who died of a gunshot wound on Labor Day. According to a Marshall Police Department press release, Jeffery Charles Green, 48, was arrested Tuesday in connection to the murder of his common-law wife. Green was found Monday with a single gunshot wound. Police officers along with Marshall firefighters/EMTs responded to the 3000 block of Hynson Springs Road about 9:00 Monday night in reference to a gunshot victim. According to KETK, Green was transported by ambulance to Good Shepherd Medical-Center Marshall, where she later died from her injuries.
A warrant was issued Tuesday for Jeffery Green. He was arrested and placed into the Harrison County Jail at 5:42 p.m. the same day. His bond was set at $250,000 on the murder charge, which is a first-degree felony. The charge carries a possible life sentence.
TYLER – A 34-year-old Tyler man has pleaded guilty to federal firearms violations. Craig Elroy Knight pleaded guilty in Tyler to an Information charging him with theft of explosives from a federally licensed dealer. According to information presented in court, on Sep. 25, 2009, Knight was involved in the burglary of a locked storage unit at Owens Oil Tools, a Tyler oil field equipment company. The secured storage unit contained approximately 400 pounds of explosives, which were taken from the property and hidden. All of the explosives have since been recovered and secured. Knight faces up to 20 years in federal prison and is in custody pending a sentencing date.
This case is being prosecuted as part of the Project Safe Neighborhoods Initiative. Officials say Project Safe Neighborhoods is aimed at reducing gun and gang violence; deterring illegal possession of guns, ammunition and body armor; and improving the safety of residents in the Eastern District of Texas. Participants in the initiative include community members and organizations as well as federal, state and local law enforcement agencies.
TYLER – A 61-year-old Smith County man, formerly of Searcy, Arkansas, has pleaded guilty in Tyler to federal bank robbery charges. Eddie Ray Myers entered his plea Tuesday. According to information presented in court, on July 14, Myers robbed a BBVA Compass Bank branch on South Broadway in Tyler. Myers entered the bank and passed a note to the teller stating, “No alarms – no dye packs, I have a gun – smile.” He then fled the bank with U.S. currency. A federal grand jury returned an indictment on Aug. 4, charging Myers with bank robbery. Myers faces up to 20 years in federal prison at sentencing. A sentencing date has not been set.
LONGVIEW — A hit and run accident in Longview Saturday leaves one man dead and a 22-year-old in custody. Authorities say a pedestrian, 45-year-old William J. Jones, was found lying in the road on East Marshall around midnight. He died Monday at a local hospital. Witnesses at the scene gave a description of the vehicle which was later stopped. The driver, Anna Catherine Shore of Longview reportedly showed signs of intoxication and was arrested for failing to stop at an accident and for driving with a suspended license. Additional charges are pending the results of a blood analysis. Shore was booked into the Gregg County Jail.
TYLER — Have a hobby? Want to show off your painting or needlepoint skills? Then the 95th East Texas State Fair Creative Arts Competition just may be the place for you. Area artisans are invited to submit their wares. Creative Arts catalogs were mailed in July; you can also go to http://www.etstatefair.com to access them online. The competition has 23 divisions including canned goods, crafts, and hobbies, with special divisions included for youth submissions. New divisions this year are cake decorating and special populations. A complete list of divisions is available online along with registration forms.
Exhibits will be received on Thursday, September 9, from 2:00pm until 6:30pm, and Saturday, September 11, from 9:00am until 12:30pm. All submissions must be made in person and will only be accepted on those two dates. Winning premiums will be paid Monday, September 27, through Saturday, October 2. The fair runs September 23 through October 3.
TYLER — Preparations continue for Tyler’s 77th Texas Rose Festival, set for October 14 through 16. Public ticket sales got underway this month for all Festival events (Ladies’ Brunch, Men’s Luncheon, Matinee, Coronation and Parade); you have until September 15 to get Parade Applications in to the festival.

TYLER — Michael Wilcox is a hearing loss resource specialist for the Tyler-based East Texas Center for Independent Living. On KTBB “Staff Meeting,” Wilcox said his job has many facets –including working with businesses to create a better environment for hard-of-hearing workers. Wilcox says, “I come into the workplace, and sometimes I evaluate their work conditions and see what changes we need to make to help them out.” Wilcox adds that 31.5 million people in the U.S. suffer from hearing difficulties but lots of help is available, including some new technology to improve hearing. You can help too, by remembering some basics of communicating with hard-of-hearing people. Among other things, Wilcox says raise your voice a bit, but don’t shout; speak clearly and at a moderate rate. “But the biggest thing, I think,” notes Wilcox, “is to be patient, to be positive, and be relaxed.”

HENDERSON — A two vehicle accident in Rusk County has killed one person and injured one. The accident happened on State Highway 42. Killed was Lillian McAfee, 89, of Overton. Her husband, Claude McAfee, 91, who was driving, was injured. The Department of Public Safety report said the couple was south bound and rear ended a truck making a left turn onto County Road 162.
TYLER — A 22-year-old is arrested after Tyler Police respond to a burglary call. It happened Friday night around 10:45 at Bruno’s Pizza, 1400 South Vine. Officers arrived and found a sliding glass door had been broken out. While officers were securing the scene, they located Danny Keith Jackson, Tyler, inside. Police say Jackson had entered the restaurant and began destroying items within the business. Jackson fled the scene when he noticed the officers and after a short foot pursuit, was arrested. He was booked into the Smith County Jail for criminal trespass, criminal mischief and evading arrest.
KILGORE – Harrison County Judge Richard Anderson announces receiving a letter of intent from Amtrak officials that TxDOT and Amtrak will soon be requesting the Union Pacific Railroad (UP) to move forward with a feasibility study for additional passenger rail services along the 1-20 / US 59 corridors in East Texas. According to KETK, Anderson is the East Texas Corridor Council’s (ETCC) governmental affairs chair. The information comes in a news release from the East Texas Council of Governments.
A letter from Amtrak’s Vice President, Transportation, Richard Phelps, received on August 17, states an agreement should be reached in the next several weeks to finalize reimbursement of capacity modeling expenses during the study. Phelps states Amtrak is fully prepared to then finalize an agreement with TxDOT and progress with the feasibility study. At that time, officials say, UP will also be able to provide Amtrak and TxDOT with an estimated timing for completion of its portion of the study, which will permit Amtrak to progress with the development of the scope and cost of capital expenditures that may be required to begin the service. This will also include an analysis of projected ridership and revenues for the new service.
“Not since the reintroduction of passenger rail service to East Texas in 1974 has TxDOT, Amtrak and the public need all been in agreement on the importance of moving forward with this project,” says ETCC Chair Tim Vaughn. “This is the most significant event in passenger rail service in East Texas since 1974,” says Anderson.
